mircea_popescu Gerard E. Lynch, southern new york kicks so much ass he will be hereby introduced into bitcoin's public record. he says : [03:33]
mircea_popescu The Agreement provides that in the event of termination, no party shall be liable beyond the specific liabilities imposed in the Agreement (i.e., the termination fee), except “that no such termination shall relieve any party … from any liability or damages resulting from the wilful and material breach … by a party of any of its representations, warranties, covenants or agreements set forth in this Agreement.” ( [03:33]
mircea_popescu Agreement § 7.02; emphasis added). J&J argues that defendants’ conduct was “wilful.” Whether a factfinder could so find depends on the meaning of that term as it is used in the Agreement. While defendants argue that a breach is only willful if it is committed with malice or in bad faith, plaintiff [J&J] contends that “wilful” merely means “intentional.” [03:33]
mircea_popescu In support of their argument that the Agreement preserves liability only for malicious breaches, defendants argue that the word “willful” would be unnecessary unless it meant “malicious.” There is no reason to limit liability to breaches that are intentional, they claim, because any breach of this Agreement would be intentional—”[h]eavily counseled parties to mega-mergers do not breach merger agreements out [03:33]
mircea_popescu of inadvertence, negligence, or mistake.” (Guidant/BSC Reply 5.) As a factual matter, this claim is questionable. It could just as well be said that heavily counseled parties to mega-mergers do not sign merger agreements containing glaringly ambiguous terms that lead to avoidable litigation—but here we are. bgupta mircea_popescu: Would bbet consider allowing bets to close more than one week before the "resolution date"? I think if that change were made it might draw out more "long shot" bettors early in the process, that just get overwhelmed by late betters when that long-shot becomes more of the high-probability outcome. (My anecdotal observations, see late betters just bet big and screw the early bettors despite th [04:27]

bgupta mircea_popescu: well for example, any bet that resolves end of this year, betting can currently only close on xmas day. (or if the net resolves early.) e.g. XYZ will happen in 2013. If the probability of outcome changes drastically between the start of betting and the closing of betting, those that bet early on the low probility event kinda get screwed by people piling on one it looks more like a sure thing, [04:45]
bgupta despite the weighting. [04:45]
mircea_popescu ThickAsThieves i don't understand that at all. [04:45]
bgupta I'd say the compromise would be a minimum betting window. [04:46]
mircea_popescu bgupta let's be abstract here. the risk over time functional is probably not a polynomial, but something more c omplex, perhaps even discrete. the weight is linear. obviously these won't match [04:46]
assbot [BTCTC] [ASICMINER-PT] 6 @ 1.39016666 = 8.341 BTC [-] {2} [04:46]
bgupta say a month or so. [04:46]
mircea_popescu as in, the real risk over time will dip under or over [04:46]
mircea_popescu originally i had in the draft for this thing an ability for the bettor to introduce an arbitrary weigh curve, and the site to interpret that functional. [04:46]
ThickAsThieves i think it's overthinking it, and kako's comprmise might cover it [04:47]
mircea_popescu the problems were that this is not straightforward to do (as good notation is something maybe half the math grads understand, and wysiwyg notation of curves we don't have yet on computers, in spite of 50 years of efforts started at parc) [04:47]
ThickAsThieves just allow like 60 days or somesuch [04:47]

ThickAsThieves two guys talk shit, wanna make a bet? yeah let's make one on bitbet! [04:50]
bgupta Yeah you'd have the issue of a bunch of unresolved bets, but I think that could be dealt with on the UX side. (Custom weighting could help, but it doesn't solve the issue, it just means late bettors would have to bet even more, which could work I guess, but makes the math required, more conplex for users.) [04:50]
mircea_popescu on the grounds that there exists something more credible than me holding it, except we've not yet discovered it./ [04:50]

Currently betting yes on that might be considered a bit of a long shot. But if btc came close to trading near 1000 USD any time before Dec 24th 2014, folks would pile o [05:11]
* agamemnon23 (~agamemnon@arkhammer.mycenae.org) has joined #bitcoin-assets [05:11]
bgupta YES, and then the early bettors would have their winning majorly diluted. [05:11]
bgupta Another example would be structuring a sports bet that closes for betting at the beginning of a season, but resolves at the end of a season. I think enabling these kinds of bets would bring in more betters, at the cost of holding onto their btc for a long time, and dealing with a potentially large book of unresolved bets. [05:11]
